Terms and Conditions

These conditions are exclusively valid between M.D.M. Italia SRL, with its registered office at Via Giuseppe Garibaldi 5, 09125 Cagliari (CA), hereafter referred to as "La Revêche," and any person who makes online purchases on the website  www.lareveche.com , hereafter referred to as "CLIENT." These conditions are subject to changes, and the date of publication on the site corresponds to the date they come into effect. These conditions govern purchases made on the website  www.lareveche.com , in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code, Legislative Decree No. 206/2005, amended by Legislative Decree No. 21/2014 and Legislative Decree No. 70/2003 on electronic commerce.

1. Subject of the Contract

With these general conditions of sale, La Revêche sells and the CLIENT remotely purchases the tangible movable goods listed and offered for sale on the website  www.lareveche.com . 

The contract is concluded exclusively through the Internet, by the CLIENT accessing  www.lareveche.com  and placing an order following the procedure specified by the site. 

The client agrees to review these general conditions of sale, especially the pre-contractual information provided by La Revêche, before proceeding to confirm their order.

2. Pre-contractual Information for the Consumer – Art. 49 of Legislative Decree 206/2005

Before concluding the purchase contract, the CLIENT reviews the characteristics of the goods that are illustrated on the individual product page at the time of the CLIENT's selection. 

Before finalizing the purchase contract and before validating the order with "obligation of payment," the CLIENT is informed about:

    -The total price of the goods, detailing shipping costs and any other costs (except as provided under Article 6 for countries outside the European         Union);

    -Payment methods;

    -The deadline by which La Revêche commits to delivering the goods;

    -Conditions, terms, procedures, and any charges for exercising the right of withdrawal (Art. 7 of these conditions);

    -The existence of a legal warranty of conformity for the purchased goods;

    -Conditions of post-sale assistance and commercial warranties provided by La Revêche.

The CLIENT may, at any time and before the conclusion of the contract, acquire information about La Revêche, including its geographical address, telephone number, and email address.

3. Conclusion and Effectiveness of the Contract

The sales contract is deemed concluded with the sending by La Revêche to the CLIENT of an order confirmation email. 

The email contains the CLIENT's data, the order number, the price of the purchased goods, any shipping costs, and the delivery address to which the goods will be sent, along with a link to the website to print and store a copy of these conditions.

The CLIENT agrees to verify the accuracy of the personal data contained therein and to promptly communicate any corrections to La Revêche. 

The CLIENT has the option to cancel the order no later than one hour after receiving the confirmation email (cancellation and modification of orders are not possible during Black Friday and Cyber Monday).

La Revêche commits to describing and presenting the items sold on the site in the best possible manner. Nevertheless, some errors, inaccuracies, or minor differences between the site and the actual product may occur. Additionally, the photographs of the products presented on  www.lareveche.com  are not contractual as they are only illustrative.

La Revêche commits to deliver the goods within 20 days from the sending of the order confirmation email to the CLIENT and declines all responsibility if the delivery does not occur due to causes attributable to it.

4. Product Availability

The availability of products refers to the actual availability at the time the CLIENT places the order. This availability must, however, be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products could be sold to other CLIENTS before the confirmation of the order. 

Even following the sending of the order confirmation email by La Revêche, cases of partial or total unavailability of the goods may occur.

In such an event, the order will be automatically adjusted with the elimination of the unavailable product, and the CLIENT will be immediately informed via email.

In this case, the CLIENT will have the option to request a refund of the amount paid, which will be processed within 14 days from the request, or to wait for the restocking of the goods.

5. Payment Methods

Every payment can only be made by the CLIENT via credit cards, debit cards, or PayPal on the website  www.lareveche.com .

6. Prices

All sales prices of the products listed on the website  www.lareveche.com  are expressed in Euros and, for the territory of the European Union, include VAT. Shipping costs are included in the purchase price.

Shipments outside the European Union involve the payment of import taxes, which are the sole responsibility of the client.

The CLIENT accepts that La Revêche has the right to change its prices at any time. 

However, the goods will be invoiced based on the prices indicated on the site at the time of the creation of the order and specified in the confirmation email sent by La Revêche to the CLIENT.

In the event of a computer, manual, technical, or any other kind of error that may cause a substantial, unforeseen change in the public sale price, making it exorbitant or clearly ridiculous, the purchase order will be considered invalid and canceled, and the amount paid by the CLIENT will be refunded within 30 days from the day of cancellation.

7. Shipping Policy

All deliveries are made by DHL.

Delivery Times

La Revêche makes deliveries in Italy and the European Union within 2-4 working days (deliveries are not possible on Saturdays and Sundays). Islands, less served locations, and remote areas may require delivery within 3-5 working days.

For deliveries outside the European Union, times may vary from 3 to 5 days, subject to longer times due to customs procedures. 

Please be aware that during the Black Friday and Cyber Monday sales period, La Revêche will have a much higher order flow than usual and may not guarantee compliance with the aforementioned terms.

Customs Duties

The prices shown on the site do not include taxes and customs duties for orders destined for non-EU countries and countries subject to Brexit, as these vary depending on the specifics of the order you intend to make and must be paid directly to the courier.

Order Tracking

When the courier takes charge of the package, you will receive an email containing the tracking number, which will allow you to monitor the status of your shipment. If you do not receive the email, we invite you to check the spam folder of your email box and contact our customer service at  [email protected] .

Shipping Address

To ensure correct delivery times, we ask you to fill in all the required spaces for the shipping address. 

Please enter the name of the company, offices, or public activities, and their opening hours when it is not a home delivery. 

La Revêche is not responsible for any errors or omissions in the customer's address. For any information, you can contact our Customer Service:  [email protected] .

Other Information

For consumers from non-EEC countries, in the event of a refusal of delivery or if it is impossible to deliver the shipment for reasons not attributable to La Revêche, the shipping costs for the delivery and return of the goods and customs duties will be deducted from the refund. 

DHL provides a second delivery attempt in case of the recipient's absence. Subsequently, the order will be stored at the nearest warehouse. Storage costs may be charged to you if the delivery cannot be finalized for any problem related to the customer.

8. Right of Withdrawal (Returns)

You can request a return by exercising your right of withdrawal, without any penalty and without specifying the reason, for any product purchased on the site within 14 days from the date of delivery according to the procedures described below.

    -You must return the products in their original condition, unworn, undamaged, and unused, with all tags attached;

    -You must communicate your intention to exercise the right of withdrawal by authenticating in the reserved area or, in the case of a purchase as        a guest, by sending an email to [email protected], taking care to indicate the references of the order and the products you intend to return;

    -For orders within the European Union, a prepaid return label will be provided: available once the return procedure is completed in the reserved       area or sent through our customer service;

    -For orders outside the European Union or in Brexit countries, the return shipment will be entirely at the customer's expense, who can identify     the courier of their choice by sending the goods to M.D.M. ITALIA SRL, c/o AERRE, Via Roma snc, CAP 09013, CARBONIA (SU), Sardinia,            ITALY, and must communicate the tracking number of the shipment to [email protected];

In any case, the products must be strictly shipped within and no later than 5 days from the communication of the right of withdrawal.

Products purchased with the same order for which you exercise the right of withdrawal must be shipped in a single shipment. Therefore, you must return all the products related to the same order, for which you have exercised the right of withdrawal, together.

If the above conditions are not met, we will not proceed with the refund. In no case will goods that have not been returned in perfect condition be replaced or refunded. In such a case, the product will be returned to you at your expense, unless you expressly communicate otherwise.

Subject to the right to verify the above, the refund will be issued using the payment method used for the purchase within 14 days from the day we receive your return in our distribution center. The time required to display the amount on your credit card may vary depending on local banking procedures.

9. Size Change

In accordance with current legal provisions, the CLIENT has the right to request a size change within 14 days from the date of delivery following the procedure indicated below.

    -You must communicate your intention by sending an email to [email protected], taking care to indicate the references of the order and the            products you intend to return;

    -For orders within the European Union, a prepaid return label will be provided.

    For orders outside the European Union or in Brexit countries, the return shipment will be entirely at the customer's expense, who can identify the     courier of their choice by sending the goods to M.D.M. ITALIA SRL, c/o AERRE, Via Roma snc, CAP 09013, CARBONIA (SU), Sardinia, ITALY,     and must communicate the tracking number of the shipment to [email protected];

    -Subject to the right to verify the original conditions of the articles, unworn, undamaged, and unused, with all tags attached; the size change will      be shipped within 5 working days from the receipt of the return.

Size changes cannot be made for items purchased during Black Friday/Cyber Monday.

10. Access to the Site

The CLIENT has the right to access the site for consultation and making purchases. No other use, particularly commercial use, of the site or its content is permitted. The integrity of the elements of this site, whether sound or visual, and the related technology used remain the property of M.D.M. ITALIA SRL and are protected by intellectual property rights.

La Revêche assumes no responsibility for service failures attributable to force majeure or unforeseen circumstances, even if they arise from malfunctions and disruptions of the Internet network, in the event that it is unable to execute the order within the times provided by the contract.

11. Integrity

These General Conditions of Sale consist of all the clauses that compose them. If one or more provisions of these General Conditions of Sale are considered invalid or declared as such under the law, regulations, or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

12. Applicable Law and Competent Court

These Conditions of Use and Sale are prepared in accordance with Italian law and are regulated by it, excluding the rules of private international law that may be applicable.

Any dispute arising from the interpretation, validity, execution, fulfillment, or resolution of these Conditions of Use and Sale will be subject to the exclusive and peremptory jurisdiction of the judge of the place where you have your residence or domicile.

In any case, you can resort to the procedures for the extrajudicial resolution of disputes, as provided for in articles from 141 to 141-decies of the Consumer Code. The Online Dispute Resolution platform of the European Commission is available at  http://ec.europa.eu/odr .
